Brand names constitute a form of value for commercial products, because they suppose a savings of search costs for the consumer. The law, as a consequence, has the obligation to protect brand names. But the number of attractive brand names is not infinite and sometimes companies seek brand names which are reminiscent of others. In this article a conflict between two companies for the distinctiveness of two brand names is addressed: one Spanish company used the English common noun doughnut for (...) a product similar to the American pastry, while the other company had already registered donut as a brand name, in addition to its variants. This second company sued the first on the grounds that the names were not distinctive. Here we offer the arguments presented to the judge in defense of the distinctiveness of doughnut and the judgment. (shrink)

Cognitive symptoms after COVID-19 have been increasingly recognized several months after the acute infection and have been designated as “brain fog.” We report a patient with cognitive symptoms that started immediately after COVID-19, in which cerebrospinal fluid biomarkers were highly suggestive of Alzheimer’s disease. Our case highlights the need to examine patients with cognitive symptoms following COVID-19 comprehensively. A detailed assessment combining clinical, cognitive, and biomarker studies may help disentangle the underlying mechanisms associated with cognitive dysfunction in each case. The recruitment of respondents belonging to ethnic minorities poses important challenges in social and health research. This paper reflects on the enablers and barriers to recruitment that we encountered in our research work with persons belonging to ethnic minorities. Additionally, we applied the Matching Model of Recruitment, a theoretical framework concerning minority recruitment, to guide our reflection. We also explored its applicability as a research design tool. In assessing our research experience, we learned that minority recruitment in social and health (...) research is influenced by the social context of all key players involved in the research. Also, there are enablers and barriers within that social context facilitating or delaying the recruitment process. The main enablers to recruit respondents belonging to ethnic minorities include working with community agencies and gatekeepers who share a common vision with researchers and the latter’s ability to gain the trust of potential respondents. The main barriers include demanding too much from these same community agencies and gatekeepers and ignoring factors that could delay the completion of the research. Although we found the Matching Model of Recruitment to be an effective tool in assessing the processes of recruiting respondents belonging to ethnic minorities, further empirical research is needed to explore its usefulness during the research planning phase. Hoerl & McCormack propose that animals learn sequences through an entrainment-like process, rather than tracking the temporal addresses of each event in a given sequence. However, past research suggests that animals form “temporal maps” of sequential events and also comprehend the concept of ordinal position. These findings suggest that a clarification or qualification of the authors’ hypothesis is needed.

BackgroundAdvance directives imply the promise of determining future medical treatment in case of decisional incapacity. However, clinical practice increasingly indicates that standardized ADs often fail to support patients’ autonomy. To date, little data are available about the quality and impact of ADs on end-of-life decisions for incapacitated acute stroke patients.MethodsWe analyzed the ADs of patients with fatal stroke, focusing on: their availability and type, stated circumstances to which the AD should apply, and stated wishes regarding specific treatment options.ResultsBetween 2011 and (...) 2014, 143 patients died during their hospitalization on our stroke unit. Forty-two of them had a completed and signed, written AD, as reported by their family, but only 35 ADs were available. The circumstances in which the AD should apply were stated by 21/35 as a “terminal condition that will cause death within a relatively short time” or an ongoing “dying process.” A retrospective review found only 16 of 35 ADs described circumstances that, according to the medical file, could have been considered applicable by the treating physicians. A majority of patients objected to cardiopulmonary resuscitation, mechanical ventilation, and artificial nutrition, while almost all directed that treatment for alleviation of pain or discomfort should be provided at all times even if it could hasten death.ConclusionsThe prevalence of ADs among patients who die from acute stroke is still low. A major flaw of the ADs in our cohort was their attempt to determine single medical procedures without focusing on a precise description of applicable scenarios. Therefore, less than half of the ADs were considered applicable for severe acute stroke. These findings stress the need to foster educational programs for the general public about advance care planning to facilitate the processing of timely, comprehensive, and individualized end-of-life decision-making. Relational reasoning is a complex form of human cognition involving the evaluation of relations between mental representations of information. Prior studies have modified stimulus properties of relational reasoning problems and examined differences in difficulty between different problem types. While subsets of these stimulus properties have been addressed in separate studies, there has not been a comprehensive study, to our knowledge, which investigates all of these properties in the same set of stimuli. This investigative gap has resulted in different findings across (...) studies which vary in task design, making it challenging to determine what stimulus properties make relational reasoning—and the putative formation of mental models underlying reasoning—difficult. In this article, we present the Multidimensional Relational Reasoning Task, a task which systematically varied an array of stimulus properties within a single set of relational reasoning problems. Using a mixed-effects framework, we demonstrate that reasoning problems containing a greater number of the premises as well as multidimensional relations led to greater task difficulty. The MRRT has been made publicly available for use in future research, along with normative data regarding the relative difficulty of each problem. (shrink)

The state of debates around the topic of `populism' has made clear the difficulties that exist to provide a coherent definition of the concept. There is much to be argued from historical, epistemological, comparative and sociological perspectives that may provide clarity to the uses of the term. As the world meets new scenarios of uncommon styles of doing politics and the themes of ideological polarization and social segregation take hold, the question about the value of `populism' as a theoretical tool (...) needs to be met with an affirmative stance that delineates its principal characteristics. The present text introduces the reader to four new perspectives that serve such a purpose and locates them among the relevant contemporary literature. (shrink)

This article offers a brief critical summary of our Populism(s) project to date, and introduces Thesis Eleven readers to the articles edited in this Special Issue. We comment on significant recent developments on populism scholarship, and reflect about the most recent developments currently taking place and their (potential) impact on current populism research.

Recent studies have problematized on the lack of agreement between self-reported and proxied data in the field of road safety-related behaviors. Overall, and although these studies are still scarce, most of them suggest that the way we perceive our own road behavior is systematically different from the perspective from which we perceive others' behavior, and vice versa. The aim of this review paper was to target the number and type of studies that have researched the behavioral perceptions of different groups (...) of road users, contrasting self-reported behavioral data with those reported by other users, and their outcomes. This systematic review followed the PRISMA methodology, which allows for the identification of relevant articles based on the research term. A total number of 222 indexed articles were filtered, and a final selection of 19 articles directly addressing the issue was obtained. Search strategies were developed and conducted in MEDLINE, WOS, Scopus and APA databases. It is remarkable how road users perceive themselves as behaviorally “safer” than the rest of road users in what concerns the knowledge of traffic norms and their on-road performance. In addition, and regardless of the type of user used as a source, self-reported data suggest their perceived likelihood to suffer a traffic crash is lesser if compared to any other user. On the other hand, proxied reports tend to undervalue third users' performance, and to perceive riskier behaviors and crash-related risks among them. The outputs of this systematic review support the idea that the perception of road users' behavior and its related risks substantially differ according to the source. It is also necessary to increase the number, coverage and rigor of studies on this matter, perhaps through complementary and mixed measures, in order to properly understand and face the bias on road users' risk-related behaviors. What is a conflict of interest? What is morally problematic about one? Beginning with the definition, this paper organizes the core literature and creates two continuums—one devoted to the more specific definition of ‘interest,’ and the other to that of ‘duty’. Each continuum places the authors according to the narrowness or broadness of their positions, which facilitates the understanding of the debate as well as what is at stake when defining conflicts of interest. The paper then develops a moral analysis (...) that leads to the sought-for definition and to an explanation of why we should treat conflicts of interest carefully. While doing so, the paper discloses the criterion to judge whether a definition is right and presents the duties that makes conflicts of interest special as ‘tertiary’ duties of morality. (shrink)

This paper focuses on segmenting digital movie and TV series pirates and on investigating the effectiveness of piracy-combatting measures i.e., legal and educational strategies, in light of these segments. To address these research objectives, two online studies were conducted. First, 1277 valid responses were gathered with an online survey. Four pirate segments were found based on differing combinations of attitude toward piracy, ethical evaluation of piracy and feelings of guilt. The anti-pirate, conflicted pirate, cavalier pirate, and die-hard pirate can be (...) placed on a continuum of increasing pirating frequency, subjective norm, pirating self-efficacy, habit, and decreasing in perceived harm, respectively. The segments also differ in deontological and teleological orientations. Second, in an experimental mixed design, we find that the educational strategy is more effective than the legal strategy in lowering pirating intentions for the conflicted and cavalier pirate. However, both strategies fail at lowering intentions of the die-hard pirate, although perceived harm and perceived impunity were significantly influenced. These findings offer a more profound understanding of pirate segments and how they react differently to piracy-combatting measures. As a result, better strategies can be developed to control digital piracy. (shrink)

The natural interpretation of counterfactuals with disjunctive antecedents involves selecting from each of the disjuncts the worlds that come closest to the world of evaluation. It has been long noticed that capturing this interpretation poses a problem for a minimal change semantics for counterfactuals, because selecting the closest worlds from each disjunct requires accessing the denotation of the disjuncts from the denotation of the disjunctive antecedent, which the standard boolean analysis of or does not allow (Creary and Hill, Philosophy of (...) Science 43:341–344, 1975; Nute, Journal of Philosophy 72:773–778, 1975; Fine, Mind 84(335):451–458, 1975; Ellis et al. Journal of Philosophical Logic 6:335–357, 1977). This paper argues that the failure to capture the natural interpretation of disjunctive counterfactuals provides no reason to abandon a minimal change semantics. It shows that the natural interpretation of disjunctive counterfactuals is expected once we refine our assumptions about the semantics of or and the logical form of conditionals, and (i) we assume that disjunctions introduce propositional alternatives in the semantic derivation, in line with independently motivated proposals about the semantics of or (Aloni, 2003a; Simons, Natural Language Semantics 13:271–316, 2005; Alonso-Ovalle, Disjunction in Alternative Semantics. PhD thesis, 2006); and (ii) we treat conditionals as correlative constructions, as advocated in von Fintel (1994), Izvorski (Proceedings of NELS 26, 1996), Bhatt and Pancheva (2006), and Schlenker (2004). In Alfonso de Cartagena's 'Memoriale virtutum' (1422) María Morrás and Jeremy Lawrance offer a new edition from the manuscripts of a compilation of Aristotle's Nicomachean Ethics addressed by the major Castilian intellectual of the day, bishop Alfonso de Cartagena, to the heir to the throne of Portugal, crown prince Duarte. The work was a speculum principis, an education for the future king in the virtues suitable to a statesman; Cartagena's choice of Aristotle was thus a significant index of the advent (...) of new Renaissance ideas. This edition shows how the "memorial" throws light on the ideological transformation of society those ideas would bring, setting new ethical guidelines for the ruling class at the crossroads between medieval feudalism and Renaissance absolutism.
